It's Noa Pty Ltd (ACN 698 453 477)
1. About these Terms
Welcome to It's Noa. These Terms & Conditions ("Terms") apply to your use of our website at https://its-noa.ai/ and any related pages we operate (the "Site"). The Site is operated by It's Noa Pty Ltd (ACN 698 453 477) ("It's Noa", "we", "us", "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover use of the Site only. Access to and use of the It's Noa platform is governed by a separate agreement between It's Noa and the relevant client. Where there is any inconsistency between these Terms and a platform agreement, the platform agreement applies to platform use.
2. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on the Site, with the date of the most recent update shown above. Your continued use of the Site after an update means you accept the updated Terms.
3. Use of the Site
You may access and use the Site for your own business and informational purposes. You agree to use the Site lawfully and not to:
interfere with or disrupt the Site, its security, or the servers and networks that support it;
attempt to gain unauthorised access to any part of the Site, other users' information, or our systems;
use any automated means (including scrapers, bots or crawlers) to access or collect content from the Site without our written permission, other than standard search engine indexing;
introduce viruses, malware or other harmful code;
use the Site to send unsolicited communications or to collect information about others without their consent; or
misrepresent your identity or affiliation with any person or organisation.
We may suspend or restrict access to the Site, or any part of it, at any time without notice.
4. Content and intellectual property
All content on the Site, including text, copy, graphics, logos, designs, reports, white papers, videos and other materials, is owned by or licensed to It's Noa and is protected by intellectual property laws.
"It's Noa" and our logos are our trade marks. You may not use them without our prior written consent.
You may view, download and print content from the Site for your own internal business and informational purposes, provided you keep all copyright and other proprietary notices intact. You may not otherwise reproduce, modify, distribute, publish, or create derivative works from Site content without our written permission.
Where we make specific resources available for download (such as white papers or guides), your use of those resources is for your internal purposes only unless stated otherwise.
5. General information only
The content on the Site, including blog posts, white papers, case studies and other resources, is provided for general information purposes only. It does not constitute professional, legal, financial or other advice, and should not be relied on as such. You should make your own enquiries and seek your own advice before acting on anything on the Site.
While we take care to keep the Site accurate and up to date, we do not guarantee that content is complete, current or error free.
6. Resources, forms and communications
Parts of the Site allow you to provide information to us, for example to download a resource, subscribe to updates, or book a demo. When you do, you agree that the information you provide is accurate, and our collection and handling of your personal information is governed by our Privacy Policy.
If you subscribe to communications from us, you can unsubscribe at any time using the link in any email or by contacting us at privacy@its-noa.ai.
7. Feedback and ideas
If you choose to send us feedback, suggestions or ideas about the Site, our platform or our business, you agree that we may use them without restriction or obligation to you, and that doing so does not create any confidentiality or other duty owed to you. This does not affect any rights you have in your own personal information, which is handled under our Privacy Policy.
8. Security
We take measures to protect the security of the Site and the information provided through it. However, no website or internet transmission can be guaranteed as completely secure, and you provide information through the Site at your own risk.
9. Third-party sites and services
The Site may contain links to third-party websites or services, including our integration partners. These links are provided for convenience only. We do not control third-party sites and are not responsible for their content, availability or privacy practices. Accessing them is at your own risk, and any dealings you have with a third party are between you and that party.
10. Availability
We aim to keep the Site available and functioning, but we do not promise that it will be uninterrupted, error free or free of harmful components. We may change, suspend or discontinue any part of the Site at any time.
11. Liability
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified by agreement.
Subject to that:
the Site and its content are provided on an "as is" and "as available" basis, and we exclude all other representations, warranties and guarantees, whether express or implied;
we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of, or inability to use, the Site; and
to the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Site or these Terms is limited to AUD $100.
Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.
12. Your responsibility
You agree to compensate us for any loss we reasonably suffer arising from your breach of these Terms or your unlawful use of the Site, except to the extent we caused or contributed to that loss.
13. Privacy
Our collection, use and disclosure of personal information in connection with the Site is described in our Privacy Policy, which forms part of these Terms.
14. General
If any part of these Terms is found to be invalid or unenforceable, that part will be read down or severed and the rest of the Terms will continue to apply. A failure by us to enforce any right under these Terms is not a waiver of that right.
These Terms, together with the Privacy Policy and any other policies published on the Site, make up the entire agreement between you and us in relation to your use of the Site.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them.
